Form 6765 in 2026: build the project-to-cost map before filing season
A practical guide to Section G's effective tax years, reporting exceptions and the evidence map engineering and finance should prepare.
A research-credit study becomes harder when engineering describes initiatives, finance tracks departments and the tax preparer needs business components. The new reporting detail in Form 6765 exposes that mismatch. The valuable preparation work is to connect those views while the people who did the work can still explain it.
The first distinction is easy to miss: a return filed during 2026 is not necessarily a return for a tax year beginning in 2026. A company preparing its calendar-year 2025 return in 2026 needs to check the rules for that underlying tax year.
This article uses the IRS instructions available on October 7, 2026. It addresses reporting preparation, not a determination that an activity or expense qualifies.
Know which reporting requirement applies
Section G is optional for tax years beginning before 2026. For years beginning after 2025 it is required, with exceptions: qualified small businesses making the specified payroll-credit election; or original-return filers with controlled-group QREs of $1.5 million or less and three-year average gross receipts of $50 million or less. These are separate conditions, not a blanket “small company” exemption. Report components in descending QRE order to cover at least 80%, capped at 50 components; aggregate the remainder. Separate-return controlled-group members have specific reporting rules. Column 49(f)'s discovery description is not required on timely original returns, including extensions. IRS Form 6765 instructions, Section G.
For preparation, ask the tax adviser to record the applicable year, filing type, exception conclusion and supporting amounts in one short decision note. Save the current instructions with that note. This prevents a team from repeating a stale rule from an older draft or assuming that an exception removes the need to support the claim.
Start with a component register
The form asks for a component's name or identifier, entity information, component type, relevant software classification and specified expense categories. Wage reporting separates research, supervision and support. Supplies, computer rental or lease costs, and contract research appear separately. IRS Form 6765, Sections F and G.
A register is the bridge between that reporting structure and daily work. It should have stable IDs that survive a renamed product, a repository split or a change of project manager. Useful preparation fields include:
- The proposed component and the product or process it belongs to.
- The company entity and period of work.
- An engineering owner who can explain the technical work.
- Linked design decisions, issues, experiments and changes.
- Proposed cost connections, their source and their review status.
Do not make every repository a business component by default. A single product can span several repositories, while one repository can hold unrelated work. Likewise, one cloud billing project can pay for several business initiatives. The register should explain the mapping rather than inherit accidental tool boundaries.
The underlying regulation applies qualification requirements at the business-component level. That is why a reviewer needs a reasoned boundary for the work being examined. Treasury Regulation 1.41-4(b).
Make the ranking reproducible
Consider a fictional company whose adviser has already identified $2 million of QREs across six components. The reporting calculation below assumes that Section G applies; it does not decide eligibility.
| Component | Reviewed QRE amount | Cumulative share |
|---|---|---|
| Routing engine | $700,000 | 35% |
| Document extraction | $500,000 | 60% |
| Synchronization service | $400,000 | 80% |
| Three remaining components | $400,000 | 100% |
The first three reach 80%; the remaining amount stays in the aggregate row. The arithmetic is simple. The difficult part is retaining the reviewed expense detail that produces each number.
Save the input population, the ordering calculation and the output rows together. If a reviewer moves $80,000 between components, rerun the ranking and record the reason. A screenshot of the earlier table is insufficient to explain the final return.
Also distinguish this reporting selection from an eligibility sampling method. Selecting the largest components for a form does not establish that the unlisted activity qualifies. Keep the full cost population available behind the summarized presentation.
Give AI a bounded job
AI can help organize a pile of engineering records into candidate projects, identify inconsistent names, or draft a short description with linked sources. A useful review queue might say, “These three issues mention the same latency target; confirm whether they belong to component BC-014.” That is a narrower and more inspectable task than asking a model to produce a finished credit study.
Keep three columns: the source fact, the proposed interpretation and the reviewer decision. If a model suggests that an employee supported a component, the supporting record should be visible. A commit authored by that employee does not by itself establish a qualified wage amount, a time allocation or direct-supervision status.
The wage categories have their own substantive rules. For example, the regulation distinguishes direct supervision and direct support from more remote management and general administrative services. Resolve that classification with the preparer rather than letting job titles determine the result. Treasury Regulation 1.41-2(c).
The same discipline helps connect AI costs. Preserve a model-provider invoice, the usage records available for the period and the proposed project association. A billing label containing “research” should never act as the final eligibility decision.
Original returns and refund claims need separate checklists
An amended return claiming a new or increased research credit can involve additional information requirements. The IRS's current refund-claim FAQ calls for the business components, activities by component and specified expense totals. Since June 18, 2024, it has waived submission of individual names and what each individual sought to discover at the initial claim stage, while retaining the ability to request that information during examination. IRS research-credit refund-claim FAQ, question 21.
A practical intake question is therefore “What return are we preparing?” Include original, amended and relevant partnership procedures as distinct possibilities for the adviser to resolve. Do not copy a refund-claim checklist onto every original return and tell customers the IRS requires every field in every case.
Conversely, do not delete useful source records merely because they need not be attached to the initial filing. A submission packet and its underlying evidence are different deliverables.
An achievable quarter-end routine
Start with the few projects representing most of the spending. Ask each technical owner to review the project boundary, relevant period and missing records. Ask finance to reconcile payroll and invoices to the ledger. Ask the preparer to resolve the tax classifications and reporting treatment.
Track the time that process takes. If the next quarter needs fewer interviews, fewer unexplained allocations and fewer reopened decisions, the evidence workflow is improving. Those are measurable operational gains; they need not be translated into an invented tax-savings percentage.
Proforma can provide a shared starting point for the records and gaps in an initial evidence review, including manual preparation. The resulting questions should make the adviser conversation more precise. The platform does not automatically file Form 6765 or certify that a component passes the tax tests.
